Activity Waiver & Release

Over The Rainbow Yoga LLC

By booking a class, workshop, private session, event, or other yoga-related activity with Over The Rainbow Yoga LLC and checking the Activity Waiver & Release checkbox, I acknowledge that I have read, understood, and agree to the terms of this Activity Waiver & Release Agreement.

1. Assumption of Risk

I understand that yoga includes physical movement, stretching, strengthening, breathwork, meditation, relaxation, and other wellness practices. I understand that participation in yoga involves inherent risks, including but not limited to muscle strain, joint injury, falls, dizziness, overexertion, aggravation of existing conditions, serious injury, or, in rare cases, death.

 

I voluntarily choose to participate and accept full responsibility for my own safety, health, and wellbeing during all activities offered by Over The Rainbow Yoga LLC.

2. Health & Medical Responsibility

I acknowledge that yoga is not a substitute for medical care, diagnosis, or treatment. I understand that certain medical conditions may make participation unsafe.

 

I confirm that I am physically able to participate in yoga and that I am responsible for consulting with a licensed medical provider before participating if I have any medical conditions, injuries, limitations, concerns, or if I am pregnant, postpartum, or recovering from childbirth.

 

If I experience pain, dizziness, shortness of breath, discomfort, fatigue, or any other concerning symptoms during class, I agree to stop immediately, modify the posture, rest, use props, or ask the instructor for support.

3. Pregnancy & Postnatal Participation

If I am pregnant, become pregnant, or am postnatal, I understand that I am responsible for obtaining approval from my healthcare provider before participating. I also agree to inform the instructor before class so appropriate modifications may be offered when possible.

4. Release of Liability

In consideration of being permitted to participate in yoga classes, workshops, private sessions, events, or any related activity, I hereby release, waive, and discharge Over The Rainbow Yoga LLC, its owners, instructors, employees, contractors, agents, representatives, successors, and assigns from any and all claims, demands, causes of action, liability, damages, costs, or expenses arising from my participation.

 

This release includes, but is not limited to, claims for personal injury, illness, property loss, property damage, or death, whether caused by ordinary negligence or otherwise, to the fullest extent permitted by law.

5. Personal Responsibility

I understand that I am responsible for listening to my body and practicing within my own abilities and limitations. I understand that any instruction, adjustment, suggestion, or modification offered by an instructor is optional, and I may choose not to participate in any posture, movement, or activity at any time.

 

I agree that I will not hold Over The Rainbow Yoga LLC or its instructors responsible for any injury, loss, or damage that may occur as a result of my participation.

6. Outdoor Classes & Environmental Risks

I understand that some classes may take place outdoors, including on grass, sand, beach areas, parks, or other outdoor locations. I acknowledge that outdoor activities may involve additional risks, including uneven ground, weather conditions, heat, sun exposure, insects, wind, rain, slippery surfaces, or other natural conditions.

 

I agree to take reasonable precautions, including bringing water, sun protection, appropriate clothing, and any personal items needed for my safety and comfort.

7. Binding Agreement

I understand that this Agreement is binding upon me, my heirs, spouse, children, legal representatives, executors, administrators, successors, and assigns.

 

I agree not to bring any legal action or claim against Over The Rainbow Yoga LLC, its owners, instructors, employees, contractors, agents, or representatives for any injury, loss, or damage arising from my participation in any activity.

8. Entire Agreement

I acknowledge that I have carefully read this Agreement, fully understand its terms, and agree to it freely and voluntarily. I understand that by checking the Activity Waiver & Release checkbox and purchasing or booking a class, package, private session, workshop, or event, I am agreeing to be legally bound by this Agreement.

9. Governing Law

This Agreement shall be governed by and interpreted according to the laws of the State of Hawaiʻi.
